Planning & Highways Committee

Terms of Reference

Description:

  • The Planning & Highways committee must fairly consider what comments are made on all planning applications, including recommendations and has an obligation to ensure that relevant parties [both supporters and objectors] are given an adequate hearing and will have the opportunity to speak at meetings in accordance with the standing orders of the Council.

Membership:

  • Membership is a minimum of 7 members.
  • The first order business at the first meeting of the committee after the Annual Town Council meeting will be to elect a chair.
  • A member of the Council must be chair.
  • A member of the Council can only hold one chair title of the Councils committees.

Meetings:

  • Monthly to be held 4th Tuesday at 6.30pm to precede the Lutterworth Facilities Committee which is to be held at 7pm. (but may differ in the event of a bank holiday).
  • Extraordinary meetings of the committee will be called as required by the chair in consultation with the Clerk.
  • The first order business at the first meeting of the Committee after the Annual Town Council meeting will be to elect a chair.
  • The Clerk/Deputy Clerk is responsible for acting on the decisions of the committee as directed.

Quorum:

  • Three committee members required for decision making purposes.

Delegated Authority:

  • The Planning & Highways committee has delegated powers to comment on planning applications placed before Harborough District Council and respond on behalf of the Town Council.

Responsibilities:

  • To consider all matters in relation to traffic management, including parking matters, highways, public transport, cycling, pedestrians, horse riding and street lighting.
  • To liaise with the relevant authorities regarding the placement and use of CCTV, ANPR cameras and VAS signs. To manage the equipment and to monitor its effectiveness.
  • To identify and make representations to the relevant authorities in respect of enforcement action or any matters considered to be breaches of planning regulations.
  • To deal with any other planning related matters that a meeting of the full Council considers appropriate to be referred to the Planning & Highways committee for further discussion.
  • Minutes to be circulated to all Councillors with recommendations at the next full Council meeting.
  • Issuing of an Agenda is to comply within the Town Council's standing orders – i.e. 3 clear days.
  • To discuss budgets by October and make recommendations to full Council.

Accountability:

  • All decisions apart from the delegated power will require a recommendation to go to Town Council for ratification.

Restrictions:

  • Any member of the committee can declare a non-pecuniary interest and would have to withdraw from the room and refrain from voting. If a dispensation has been granted the member may remain in the meeting, speak, and vote on the matter unless to do so would compromise their impartiality obligations or any other obligations set out in the code of conduct.
  • Any member of the committee can declare a pecuniary interest and will be required to withdraw from the room and/or abstain from voting as appropriate.

Review arrangements:

  • Appointment of the committee will be considered at the Annual Town Council meeting which may decide to alter, amend or dissolve the committee as required.
